Rules for buying and selling goods

1. General provisions

1.1. These E-shop Rules (hereinafter referred to as the “Rules”) constitute a legally binding document for the Buyer and the Seller (hereinafter referred to as the “Seller”), setting out the rights and obligations of the Parties.
1.2. The Seller reserves the right to change, amend or supplement these Terms and Conditions at any time. The Buyer shall be informed of changes to the Terms and Conditions on the website of the e-shop.

2. Conclusion of the sale and purchase agreement

2.1. The contract of sale between the Buyer and the Seller shall be deemed to have been concluded when the Buyer forms and submits an order for the goods in the online shop, having first read and understood these Terms and Conditions.

3. Seller’s rights

3.1. In the event of important circumstances, the Seller may temporarily or completely suspend the operation of the e-shop without prior notice to the Buyer.
3.2. If the Buyer attempts to undermine the operation, stability and security of the e-shop or violates his/her obligations, the Seller shall have the right to restrict or suspend his/her access to the e-shop without notice.

4. Obligations of the Seller

4.1. The Seller undertakes to make available the services of the e-shop, the conditions of operation of which are set out in these Terms and Conditions.
4.2. The Seller undertakes to deliver the goods purchased by the Buyer by the method of delivery chosen by the Buyer, in accordance with the terms and conditions set out in these Conditions of Sale and Purchase.
4.3. Where, due to unforeseen circumstances, the Seller is unable to deliver the goods ordered in the online shop, the Seller shall have the right to terminate the Purchase and Sale Contract after informing the Buyer. The seller may offer a similar product. If the Buyer refuses, the Seller undertakes to refund the money paid within 3 working days.
4.4. If the Buyer makes use of the provisions of Regulations 5.2. the right provided for in Clause 2, the Seller undertakes to reimburse the Buyer within 5 (five) working days from the date of receipt of the returned goods.
4.5. The Seller may not refund the amount paid by the Buyer until the Goods have been returned to the Seller or until the Buyer provides proof that the Goods have been dispatched to the Seller, whichever is the earlier.

5. Buyer’s rights

5.1. The Buyer has the right to purchase goods in the Online Shop in accordance with these Terms and Conditions.
5.2. The Buyer shall have the right to withdraw from the contract for the purchase of goods concluded in the online shop by notifying the Seller in writing no later than 14 (fourteen) calendar days from the date of delivery.
5.3. The Buyer may only exercise the Buyer’s right set out in clause 5.2 if the goods have not been damaged or substantially altered in appearance and have not been used.

6. Obligations of the Buyer

6.1. The Buyer shall pay for and accept the goods purchased in accordance with these Conditions.
6.2. If the Buyer refuses to accept the goods at the time of delivery without valid reasons, the Buyer shall be liable for the cost of returning the goods at the Seller’s request.

6.3. At the time of delivery of the Goods to the Buyer, the Buyer shall inspect the condition of the consignment and the Goods(s) together with the Seller or the person who delivered the consignment.
6.4. By using the online shop, the Buyer confirms that he/she accepts these Terms and Conditions of Sale and must comply with them.

7. Commodity prices

7.1. The prices of the products in the online shop are in euros. Prices include VAT. Once the order has been confirmed, a delivery charge, if applicable, is added to the total amount of the goods.


8. Ordering and payment of goods

8.1. When a customer visits an online shop, he or she chooses the items he or she likes and puts them in a shopping basket. After the shopping cart has been created, the Buyer shall enter the personal data necessary for the execution of the order: his/her name, surname, the address to which the goods will be delivered, the telephone number and any additional information that may be relevant for the delivery of the goods ordered. The Buyer acknowledges that he/she has read these rules and confirms the order.
8.3. Payments can be made using Swed, Seb, Luminor, Citadele, Šiaulių Bankas electronic banking services and Visa / MasterCard payment cards. Payments are available in euro. Payments are processed using the montonio.com payment platform.

9. Delivery of goods

9.1. When ordering goods, the Buyer must specify the exact delivery address.
9.2. The buyer must take delivery of the goods himself. If the Buyer is unable to take delivery of the goods, but the goods have been delivered to the address specified by the Buyer, the Buyer shall not be entitled to claim that the goods have been delivered to the wrong person.
9.3. The Seller shall deliver the Goods to the Buyer in accordance with the terms specified in the descriptions of the Goods.
9.4. The features of all the goods for sale are set out in the description accompanying each item. The Seller shall not be liable for the fact that the colour, shape or other parameters of the goods in the online shop may not correspond to the actual size, shape and colour of the goods due to the characteristics of the monitor used by the Buyer.
9.5. If the Buyer withdraws from the contract for the sale of the goods, the Buyer shall be refunded all sums paid by the Buyer, including the delivery costs paid by the Buyer.

10. Returning goods

10.1. Goods of good quality can be returned within 14 days of receipt. Defects in goods sold in poor quality shall be rectified, the goods shall be replaced and returned in accordance with the provisions of the Civil Code of the Republic of Lithuania.
10.2. The following conditions must be observed when returning goods:
10.2.1. The returned product must be in its original packaging in good working order (this does not apply if you are returning a faulty product);
10.2.2. The goods must be in good condition and undamaged by the Buyer;
10.2.3. The product must be unused and in good condition: labels intact, protective film intact, etc. (this does not apply in the case of returns of faulty goods);
10.2.4. The returned goods must be in the same condition as received by the Buyer (this clause does not apply in the case of the return of low quality goods);
10.2.5. The Seller has the right to refuse to accept the Buyer’s return of the Goods if the conditions for returning the Goods have not been met;
10.2.6. The return of the goods shall be carried out in the manner prescribed by the Seller within 14 (fourteen) days from the date of receipt of the goods (this clause does not apply in the case of low-quality goods, in which case the return of the goods shall be carried out within the statutory warranty period);
10.3. Returns and replacements of goods of satisfactory quality are carried out in accordance with Article 6.22810(1) of the Civil Code;
10.4. Money paid for goods accepted by the Buyer but subsequently rejected shall be refunded to the Buyer’s account no later than 5 (five) days from the date of return of the goods to the Seller, unless the Seller and the Buyer agree otherwise.

11. Final provisions

11.1. These Rules are drawn up in accordance with the legislation of the Republic of Lithuania.
11.2. These Terms and Conditions and the relationship between the Parties hereto shall be governed by and construed in accordance with the laws of the Republic of Lithuania.
11.3. Any disagreements arising out of the application of these Rules shall be settled by negotiation. In the event of disagreement, disputes shall be settled in accordance with the procedure established by the laws of the Republic of Lithuania.
11.4. The Parties shall be excused from the performance of their obligations hereunder if such performance is prevented by unforeseeable circumstances beyond the control of the Parties (Force Major).
